ELIGIBILITY: BizCom's "Revolting Business Website Contest" (the "Contest") is open to businesses (Corporations, LLC’s and Sole Proprietors) with a minimum of four (4) employees and headquartered within the United States of America. The Contest is sponsored by BizCom Web Services, Inc. (“Sponsor”) and no officers, directors, employees, or agents of Sponsor or its affiliates, subsidiaries, their suppliers, contractors or advertising and promotional agencies ("Affiliates") are eligible to enter or win.
TO ENTER: Visit http://www.revoltingwebsitecontest.com/Register.aspx to enter the URL of the nominated web site. For participants entering through this method, normal Internet access and usage charges imposed by participants' on-line service provider will apply. Entries will be accepted beginning midnight (12:00AM) November 1, 2009 through midnight (12:00AM) November 30, 2009. Limit one entry per business, regardless of the method of entry. No mechanically reproduced entries or facsimiles allowed. Sponsor is not responsible for malfunction of electronic equipment, telephone network(s) or line(s), computer hardware or software, or lost, late, illegible, mutilated, incomplete, misdirected entries or for any other technical problems related to participant’s inability to submit entry. Sponsor reserves the right to modify, suspend or terminate the Contest at any time in the event of evidence or suspicion of any tampering, unauthorized intervention, fraud or any other failures which could affect the intended conduct of the Contest as described in these Official Rules. Sponsor reserves the right to change these terms at any time. Sponsor reserves the right to disqualify anyone who interferes or tampers with the entry process or any other aspect of the Contest or fails to comply with BizCom’s standard Terms or Conditions as noted on BizCom’s website – http://www.bizcomweb.com/terms or these Official Rules. In the event of a dispute regarding identity, entries will be deemed void. All submitted entries become the property of Sponsor and will not be returned.
FINALISTS: From all valid entries received, potential winners will be selected based on the results of a popular vote at http:// www.revoltingwebsitecontest.com/Vote.aspx. Popular voting ends December 7, 2009. The Contest finalists; one (1) Grand Prize winner, one (1) runner-up winner will be selected by an independent panel of judges. Neither the Sponsor, independent panel nor any of its members have any personal interest in the outcome of the Contest. All determinations and decisions of the independent panel and Sponsor shall be final and binding on all matters relating to the Contest. The winners will be notified by email, and will, except to the extent prohibited by law, be required to sign and return an Affidavit of Eligibility/Liability and Publicity Release signed by an legal officer of the company which must be received by Sponsor within ten (10) days of notification of selection of winners or the prizes concerned will be forfeited and an alternate winner(s) will be selected from the remaining eligible entries. Return of any notification as undeliverable will also result in disqualification and selection of an alternate winner(s). PRIZES & ODDS OF WINNING: The Grand Prize winner will receive one (1) suite of web services including, and limited to; a logo redesign or refresh (up to three (3) concepts), web site redesign (one (1) concept) including BizCom’s Content Management System (BCMS Standard version), web site hosting (basic hosting package included. Visit www.bizcomweb.com for details), five (5) email accounts (POP3 service with advanced anti-spam/anti-virus protection) for a period of six (6) months, and search engine optimization and submission services to the top five (5) search engines. Winner will be responsible for supplying all web site copy to BizCom in an Microsoft Word or Notepad format. Estimated retail value of the Grand Prize is ten thousand (10,000) U.S. dollars.1st Runner Up receives a website redesign consultation and $2,000 off the design and development of a new web site (up to 10 pages) including BizCom’s Basic Content Management System. The estimated retail value of this prize is $5,000 U.S. Dollars.
Prizes may not be transferred, exchanged or substituted by the Winner(s). Odds of winning depend on the number of eligible entries received. The Sponsor is not responsible if any prize winner is unable to accept or use all or any portion of the prize due to failure to qualify or comply with these Official Rules or any law, regulation or other rules which apply to their acceptance, receipt or use of the prize award.
GENERAL: By entering, participating and/or accepting a prize, each entrant agrees: to release Sponsor and its Affiliates from all liability, loss or damage arising from entry, participation or selection in the Contest and/or the awarding, receipt, possession, use and/or misuse of the prize; to be bound by these Official Rules and that the determinations and decisions of the Sponsor are final and binding on all matters relating to the Contest; and to the use of his or her name, photographs, likenesses, biographical information, and city and state of business for advertising, trade and promotional purposes in all media worldwide (including online) in perpetuity without additional compensation, except to the extent restricted or prohibited by law. By accepting a prize, winners agree to release the Sponsor and its Affiliates from any and all liability, loss damage, personal injury, death or expense arising from or in conjunction with the awarding, receipt and/or use or misuse of any prize or participation in this Contest. All applicable federal, state, provincial and local laws and regulations apply. Each winner is responsible for all taxes.
DISPUTE RESOLUTION; LIMIT OF LIABILITY: By entering or participating in the Contest or accepting the prize, each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded, other than the administration of the Sponsor's determination of winners, which is in the sole and exclusive discretion of the Sponsor, shall be resolved without resort to any form of class action, and exclusively by the State courts of the State of North Carolina, County of Wake or the Federal court therein; (ii) any and all claims, judgments and awards to you shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees or costs; and (iii) under no circumstances will you be permitted to obtain, and you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
VIOLATION OF RULES OR LAWS: Any attempt to damage or undermine the conduct or operation of the Contest or intercept or interfere with the Contest, any entries and/or the prizes, may be a violation of criminal and civil laws and the Sponsor reserves the right to seek damages and pursue any and all remedies available, to the fullest extent of the law. The delay or failure of Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of any kind.
